Welcome to The Artists Marketplace (“we”, “us”, “our”). By accessing or using our website, membership services, or any associated features (collectively, “the Platform”), you agree to be bound by these Terms & Conditions. If you do not agree, you must not use the Platform.

1. Purpose of The Artists Marketplace

The Artists Marketplace is a curated digital platform providing portfolio hosting, artist visibility, promotional services, and lead-generation support for professional and semi-professional artists.
The platform does not act as an art dealer, broker, intermediary, or agent for standard memberships.
We do not take commission on artwork sales.

For Diamond members, optional e-commerce hosting may be offered by request and subject to approval.

2. Eligibility

Membership on The Artists Marketplace is available only to individuals who:

• Are Professional or Semi-Professional artists, and

• Create original works they have full rights to display.

We reserve the right to decline or remove artists who do not meet these standards or who compromise the curated environment of the Platform.

3. Membership Tiers & Artwork Limits

The Platform offers four membership tiers:

Emerald

• Up to 6 artworks

• Professional profile and basic visibility

Sapphire

• Up to 36 artworks

• Enhanced profile and priority placement

Ruby

• Up to 500 artworks

• Premium profile and spotlight promotional features

Diamond — Artist Representation

• Unlimited artworks

• Dedicated monthly promotional hours

• Optional e-commerce hosting by request

• Priority media, press and editorial support

4. Optional E-Commerce Hosting (Diamond Tier Only)

Diamond members may request bespoke e-commerce hosting managed by The Artists Marketplace.
This service:

• Is entirely discretionary

• Requires approval

• May be revoked at any time

• Is subject to separate operational terms

• Does not involve commission unless formally agreed in writing

For all other tiers, sales occur privately between the artist and the buyer.

5. No Commission on Sales

Except where separately agreed for optional Diamond-tier e-commerce hosting, The Artists Marketplace does not charge commission or fees relating to artwork sales or enquiries.
Artists are solely responsible for managing communication, negotiation, pricing, sales, shipping, and dispute resolution with buyers or collectors.

6. Artist Responsibilities

By using the Platform, you confirm that:

• You own full copyright to all artworks uploaded

• You have the right to display and promote your work

• Your content does not infringe any rights or breach any laws

• You are responsible for ensuring description accuracy

• You will respond to enquiries in a timely manner

• You will maintain professional standards of conduct

We may remove artworks or profiles that violate these obligations.

7. Profile Information and External Links

Your profile may include:

• A direct enquiry link

• An email contact link

• Links to your own website or external platforms

You are responsible for maintaining accurate and up-to-date information.

8. Artwork Uploads & Review

Artwork uploaded to the Platform must meet our quality and clarity standards.
We reserve the right to decline or remove images that are:

• Low resolution

• Misleading

• Copyright-infringing

• Inappropriate

• Inconsistent with the brand aesthetic

Diamond members may request our team to upload and curate content on their behalf.

9. Membership Activation, Upgrades & Changes

• Memberships begin immediately upon purchase.

• Upgrade requests activate within 24 hours.

• Benefits, artwork limits, and visibility update automatically upon activation.

• Downgrades take effect at the start of the next billing cycle.

We may update membership features at any time to improve the Platform.

10. Membership Pausing

You may pause your membership once per year for up to 60 days.
Diamond members may request additional flexibility at our discretion.

11. Payments, Renewals & Refunds

All membership payments renew automatically unless cancelled before the renewal date.
Membership fees are non-refundable.
Cancellation prevents future billing but does not refund previous payments.
Your profile remains active until the end of the paid period.

12. Visibility, Promotion & Guarantees

The Platform enhances visibility and promotional exposure but does not guarantee:

• Sales

• Enquiries

• Media features

• Press coverage

• Exhibition placement

All promotional features, including Diamond-tier representation, operate on a best-effort basis.

13. Platform Conduct & Content Removal

We reserve the right to:

• Remove content

• Remove profiles

• Pause visibility

• Decline membership

• Terminate accounts

This applies particularly where user behaviour or content conflicts with our standards, brand aesthetic, or legal obligations.

14. Intellectual Property Rights

Artists retain copyright and intellectual property rights to their work.
By uploading content, you grant us a non-exclusive, royalty-free, worldwide licence to display, promote and share your work as part of the Platform’s services, including use in social media, newsletters, and marketing materials.

You may revoke this licence by removing the artwork from your profile.

15. Liability

The Artists Marketplace is not liable for:

• Loss of sales opportunities

• Disputes between artists and buyers

• Incorrect or outdated artist information

• Third-party website links

• Technical outages, delays or interruptions

• Data loss or corrupted uploads

Our maximum liability shall not exceed the total membership fees paid in the preceding 12 months.

16. Changes to These Terms

We may update these Terms periodically.
Continued use of the Platform after updates constitutes acceptance of the revised terms.
